NAPERVILLE, Ill – An Elgin man accused of ambushing his estranged wife outside a Naperville home and firing a shot that narrowly missed her has been denied pre-trial release, according to prosecutors.
What we know:Rocky Ahmedyar, 35, appeared in DuPage County court Wednesday afternoon for his first appearance hearing.
According to the DuPage County State’s Attorney’s Office, he is charged with one count of attempted first-degree murder (a Class X felony), one count of aggravated discharge of a firearm (a Class 1 felony), one count of aggravated stalking (a Class 3 felony), and one misdemeanor count of violating an order of protection.
Ahmedyar’s wife is the victim, and he is facing an active domestic violence case and an order of protection in Kane County.
The charges stem from an incident on June 17, when Naperville police arrived at a home shortly after 3:30 a.m.
According to authorities, the victim had moved out of the family’s Elgin home with their three children and was now staying in Naperville.
According to prosecutors, the woman told police she went outside around 3:05 a.m. to leave for work when Ahmedyar approached her with a silver Kimber 9mm handgun. He allegedly told her that she needed to speak with him or he would shoot her.
According to prosecutors, the confrontation lasted about 30 minutes before Ahmedyar was forced to lower his weapon due to a passing vehicle.
As the woman reversed her car, Ahmedyar allegedly walked alongside it, raised his gun again, and told her to stop. Prosecutors say he then fired one shot.
According to prosecutors, the bullet passed through the top right of the driver’s seat and narrowly missed the victim by millimeters. Ahmedyar then fled on foot, prompting the victim to call 911.
At 4:13 a.m., Elgin police arrested Ahmedyar as he arrived at his home.
According to the state’s attorney’s office, he also sent the victim several harassing and threatening text messages, including “You watch your self,” “But b* I am not scared of your b,” and “I hope you die one day b*** because you are a virus in the world.”
What they’re saying:Domestic violence is not a private family matter; it is a serious crime that, if left unchecked, can result in serious physical harm to the victim, including death,” DuPage County State’s Attorney Robert Berlin stated.
“While the victim in this case was subjected to an extremely stressful situation allegedly at the hands of her husband, we are all grateful that she was not physically harmed. I thank the Naperville Police Department for their efforts in this case and for apprehending the defendant so quickly.
I am grateful to the West Chicago and Elgin Police Departments, as well as the DuPage County Sheriff’s Office’s K-9 Unit, for their assistance. I also want to thank Assistant State’s Attorneys Anna Derkacz and Helen Kapas for their work in bringing strong charges against Mr. Ahmedyar.”
“Domestic violence is a serious and dangerous issue that all too often escalates into violence, as alleged in this case.
I am grateful that the victim was not physically harmed, and I want to commend our officers, detectives, and the Elgin Police Department for their quick, coordinated response, which resulted in Mr. Ahmedyar’s arrest,” Naperville Chief of Police Jason Arres said.
“I also appreciate the guidance and partnership of DuPage County State’s Attorney Bob Berlin and his office throughout this investigation. We will continue to work tirelessly to hold offenders accountable and to support victims at all stages.”
